Kare Day (“we”, “our”, “us”) owns and operates the Kare Day software platform and related services (the “Service”). These Terms govern your access to and use of the Service.
By accessing or using Kare Day, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Kare Day provides cloud-based software tools for daycare management, including child records, attendance, staff time tracking, billing, reporting and parent communication features.
Access to certain features requires an active paid subscription. Subscription terms, pricing and limits are outlined on our Pricing page and may change from time to time.
You are responsible for maintaining accurate account information and safeguarding login credentials.
You are solely responsible for all activity occurring under your account, including data entered, shared or exported.
Fees are billed in advance on a monthly or yearly basis depending on your selected plan. All fees are non-refundable except where required by law.
Kare Day provides software tools only and does not provide legal, regulatory, medical, financial or childcare advice. You are solely responsible for ensuring compliance with all applicable childcare laws, licensing requirements, inspection standards and parent obligations.
Kare Day does not verify the accuracy, completeness or legality of data entered into the Service and assumes no responsibility for decisions made based on platform data.
To the maximum extent permitted by law, Kare Day shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, loss of data, inspection failures, regulatory penalties or disputes with parents or staff.
Kare Day’s total liability shall not exceed the amount paid by you to Kare Day in the three (3) months immediately preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Kare Day, its owners, employees and affiliates from any claims, damages, liabilities or expenses arising from:
Your use or misuse of the Service
Your violation of laws, regulations or licensing requirements
Your handling of child, parent or staff data
Disputes between you and parents, guardians, staff or regulators
The Service is provided “as is” and “as available” without warranties of any kind. Kare Day disclaims all implied warranties including merchantability, fitness for a particular purpose and non-infringement.
Kare Day does not guarantee uninterrupted access, error-free operation or regulatory compliance.
Kare Day may suspend or terminate access to the Service at any time for violation of these Terms or misuse of the platform, without liability.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
